SEAMAE (“we,” “our,” or “us”) respects the intellectual property rights of creators and expects our users to do the same. This policy governs the use of SEAMAE’s proprietary assets, the licensing of products sold on our platform, and our procedures for addressing claims of copyright infringement.
1. SEAMAE Proprietary Rights
All elements of the SEAMAE platform, including but not limited to the brand name, logos, website design, graphics, user interface, and underlying source code, are the exclusive intellectual property of SEAMAE.
Limited License: We grant you a limited, non-transferable license to access the platform for the purpose of purchasing or selling digital assets.
Prohibitions: Any unauthorized scraping, mirroring, or reproduction of SEAMAE’s platform assets is strictly prohibited and will be met with legal action.
2. Intellectual Property in Digital Assets
A. Licensing Model
Unless specifically stated otherwise (e.g., Open Source or PLR licenses), all products sold on SEAMAE are licensed, not sold. The copyright of the software or digital content remains with the original developer or publisher.
Scope of Use: Your purchase grants you a non-exclusive license for personal or internal business use as defined by the product’s End-User License Agreement (EULA).
Restrictions: You are prohibited from decompiling, reverse-engineering, or redistributing the digital assets unless explicitly permitted by the license holder.
B. Vendor Warranties
Every Vendor, by listing a product, warrants that they hold the necessary rights, licenses, or ownership to distribute said asset. SEAMAE performs mandatory KYC on all Vendors to ensure accountability for IP claims.
3. DMCA & UK Copyright Takedown Procedure
SEAMAE operates as an intermediary marketplace and qualifies for “Safe Harbor” protection. We have established a rigorous process for copyright owners to report alleged infringements.
To file a Notice of Infringement, please provide our Designated IP Agent at support@seatrian.shop with the following:
Identification: A description of the copyrighted work claimed to have been infringed.
Location: The specific URL(s) on
seatrian.shopwhere the material is located.Contact Information: Your full legal name, address, telephone number, and email.
Statement of Good Faith: A statement that you have a “good faith belief” that the use of the material is not authorized by the copyright owner, its agent, or the law.
Statement of Accuracy: A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner.
Signature: A physical or electronic signature.
4. Counter-Notification Procedure
If your content was removed due to a copyright claim and you believe this was a result of mistake or misidentification, you may submit a Counter-Notice to us.
Your Counter-Notice must include your contact details, identification of the material removed, and a statement consenting to the jurisdiction of the courts of London, England (or your local jurisdiction if outside the UK).
Upon receipt of a valid Counter-Notice, SEAMAE may restore the material within 10–14 business days unless the original claimant files a court action.
5. Repeat Infringer Policy
SEAMAE maintains a “Zero-Tolerance” policy for intentional IP theft.
Vendor Termination: Vendors who receive multiple valid copyright strikes will have their accounts permanently terminated and their pending balances frozen to cover potential legal indemnification.
Blacklisting: Terminated Vendors are barred from re-registering on the platform through our KYC-linked identity verification.
6. Disclaimer of Liability
While SEAMAE facilitates the removal of infringing content, we are not a judicial body. We do not mediate disputes between third parties. SEAMAE is not liable for any indirect or consequential damages arising from the presence of infringing content on the platform prior to its removal.
